These Terms of Service ("Terms") govern your access to and use of the website located at vytlfitness.com and any related services provided by Nextomic LLC, a Wyoming limited liability company doing business as VYTL FITNESS ("VYTL FITNESS," "we," "us," or "our"). By accessing or using our services, you agree to be bound by these Terms.
1. Services
VYTL FITNESS provides payment processing, software tools, and support infrastructure on behalf of independent fitness coaches, trainers, and wellness creators ("Creators"). When you purchase a subscription or product from a Creator who uses our services, your transaction is processed by VYTL FITNESS as merchant of record, and "VYTL FITNESS" will appear on your billing statement.
2. Relationship with Creators
All content, programs, coaching, advice, and deliverables purchased through our platform are provided by the individual Creator, not by VYTL FITNESS. VYTL FITNESS does not author, endorse, or verify the content or claims of any Creator. You agree that any disputes regarding content or service quality are primarily between you and the Creator.
3. Payments, Refunds, and Cancellations
Subscription terms, pricing, refund policies, and cancellation procedures are set by each individual Creator and will be disclosed at the point of purchase. VYTL FITNESS will facilitate cancellations and refunds in accordance with the Creator's stated policy. To cancel or request a refund, please contact the Creator directly or submit a support request.
4. Chargebacks
If you do not recognize a charge or have a billing dispute, please contact us before initiating a chargeback with your bank. We maintain detailed records and can typically resolve concerns more quickly than the chargeback process.
5. Entertainment Purposes Only; No Professional Advice
All content, communications, programs, messaging, videos, images, coaching, mentorship, motivational material, and any other deliverables offered, promoted, or provided by Creators through our platform (collectively, the "Creator Content") are provided strictly for entertainment and general informational purposes only. The Creator Content is not, and must not be interpreted as, medical advice, nutritional advice, psychological or mental-health advice, therapeutic advice, pharmaceutical advice, fitness or athletic training advice, financial advice, legal advice, or any other form of professional guidance or personalized consultation, regardless of how it is framed, labeled, marketed, or described by any Creator.
Creators are not licensed physicians, dietitians, nutritionists, physical therapists, mental-health professionals, or regulated fitness practitioners unless they explicitly and verifiably state so in writing with current credentials, and no statement to that effect by a Creator is verified, endorsed, or warranted by VYTL FITNESS. Even where a Creator holds such credentials, the Creator Content is general entertainment content and does not constitute a professional-client relationship of any kind.
You should consult a qualified, licensed physician or other appropriate licensed professional before starting, stopping, or modifying any training, diet, supplementation, medication, mental-health practice, or lifestyle program. You acknowledge and agree that you use the Creator Content entirely at your own risk, that you assume full and sole responsibility for any actions, decisions, or outcomes resulting from your engagement with the Creator Content, and that VYTL FITNESS and Creators shall have no liability whatsoever for any injury, illness, loss, damage, or other adverse outcome arising from your use of the Creator Content.
6. User Conduct
You agree not to use our services to violate any applicable law, infringe third-party rights, transmit harmful or unlawful content, attempt to gain unauthorized access to our systems, or interfere with the operation of the services.
7. Intellectual Property
The VYTL FITNESS name, logo, and all site content are the property of Nextomic LLC or its licensors. You may not copy, reproduce, or create derivative works without prior written permission.
8. Disclaimers and Limitation of Liability
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, VYTL FITNESS AND NEXTOMIC LLC DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
IN NO EVENT SHALL VYTL FITNESS, NEXTOMIC LLC, OR THEIR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Indemnification
You agree to indemnify and hold harmless VYTL FITNESS, Nextomic LLC, and their affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the services.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the services shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You and VYTL FITNESS waive any right to a jury trial or to participate in a class action.
11. Changes to These Terms
We may update these Terms from time to time. The updated version will be indicated by a revised "Last updated" date. Continued use of the services after changes take effect constitutes acceptance of the revised Terms.
